Ques 1: What  is  meant  by  consumer protection ?

Ans: It  refers  to  the  act  of  providing  adequate  protection  to  consumers  against  the  exploitative  and  unfair  trade  practices  of  manufactures  and  service  providers.

 

Ques 2: Give  any  one responsibility  of  a  consumer  in  addition  to  obtain a  cash  receipt  while  purchasing a  washing  machine.

Ans: ISI  mark.

 

Ques 3: Besides  a  consumer  name  any  two  parties  who  can  file  a  complaint  before  the  appropriate  consumer  forum.

Ans: (i) Any  registered  consumers’  associations.

       (ii) The  Central  Govt.  and  State  Govt.

       (iii)One  or  more  consumers,  on  behalf  of  numerous  consumers  having  the  same  interest  and

       (iv) A  legal  heir  or  representative  of  a  deceased  consumers.(any  two)

 

Ques 4: When  can  a  consumer  make  an  appeal  in  the  Supreme  Court  under  ‘The  Consumer  Protection  Act  1986?’

Ans: An  order  passed  by  the  National  Commission  in  a  matter  of  its  original  jurisdiction  is  appealable  before  the  Supreme  Court.

 

Ques 5: Anand  wants  to  buy  Gold  Jewellery.  As  an  aware  customer,  how  can  be  sure  about  the  quality  of  the  jewellery?

Ans: Hallmark  on  the  jewellery.

 

B. SHORT  ANSWER  TYPE  QUESTIONS(3 OR 4 MARKS EACH)

 

Ques 1: Explain  the  following  Rights  of  Consumers: (i) Right  to  seek  Redressal (ii) Right  to  be  Informed.

Ans:  (i) ) Right  to  seek  Redressal-The  consumer  has a right  to  get  relief  in  case  the  product  or  service  falls  short  of  his  expectations. The  Consumer  Protection  Act  provides  relief  to  consumers  such  as  replacement  of  product, removal of  defect  in  the product, conpensations for  any  loss  or  injury  suffered  by  the  consumer. (ii) ) Right  to  be  Informed-The  consumer  has  a  right  to  have  complete  information  about  the  product  he  intends  to  buy such as ingredients, date of manufacturing, price quantity etc.

 

Ques 2: How  are  consumer  grievances  redressed  by  the  three-tier  machinery  under  Consumer  Protection  Act,  1986 ?  Explain.

Ans: It  is  done  under  the  three – tier  machinery  comprising  of:                                                    

(a) District  Forum:-  A  complain  can  be  made  to  the  appropriate  District  Forum  when  the  value  of  goods or  services  in  question  along  with  the  compensation  claimed  does  not  exceed  Rs.  20  Lakhs. The  appeal  against  the  orders  of  the District  Forum  can  also  be  filed  before  the  State  Commission.                                                                                                                     

(b)  State  Commission :-  A  complain  can  be  made  to  the  appropriate  State  Commission  when  the  value  of  goods or  services  in  question  along  with  the  compensation  claimed   exeed  Rs.  20  Lakhs  but  does  not  exceed  Rs. 1  crore. The  appeal  against  the  orders  of  the State  Commission can  also  be  filed  before  the  National  Commission.                               

(c) National  Commission :- A complain can be made to the appropriate National Commission  when  the  value  of  goods or  services  in  question  along  with  the  compensation  claimed    exceed  Rs. 1  crore.  . An  order  passed  by  the  National  Commission  in  a  matter  of  its  original  jurisdiction  is  appealable  before  the  Supreme  Court . 

 

Ques 3: Jasmine  went  to  a  shopkeeper  to  buy  a  hair  oil.  The  shopkeeper  forced  her  to  buy  a  particular  brand  of  hair  oil  among  various  available  brands, irrespective  of  the  willingness  of  Jasmine.   Which  ‘Right  of  Jasmine, as  a consumer has  been  violated? Name and  explain   the  Right .

Ans:  The  right  violated  here  is  ‘Right  to  Choose’.  The  consumer  has  the  freedom  to  choose  from  a  variety  of  products  at  a competitive  prices. This  implies  that  the  marketers  should  offer  a  wide  variety  of  product  in  terms  of  quality,  brand,  prices  size  etc.  and  allow  the  consumer  to  buy  a  product  on  his  free  will.

 

Ques 4: State  any  four  responsibilities  of  a  consumer  while  purchasing/ consuming/ goods  and  services.

Ans: (i) Awareness :- Be  aware  about  various  goods  and  services  available  in  the  market  so  that  an  intelligent  and  wise  choice  can  be  made.                                                                               

  (ii) Standardized  Product:- Buy  only  Standardized  Product  as  they  provide quality assurance. 

 (iii) Risk  Knowledge:- Learn  about  the  risks  associated  with  products  and  services,  follow  manufacturer’s  instruction  and  use  the  products  safely.                                                             

 (iv) Careful  Reading :- Read  labels  carefully  to get  the  information  about  prices and follow  manufacturer’s  instructions  .                                                                                                                  

 (v) Assertion :- Assert  yourself  to  ensure  that  you  get  a  fair  deal.(any four)   

                           

Ques 5: Mr.  Jayant  purchased  a  book  from  a  book-seller  and  took  the  cash  memo  of  Rs.300  which  he  paid  for  the  book. Later  he  found  that  the  actual  price  of  the  book  is  Rs.250  but  the  book-seller  had  put  a  sticker of  Rs.300  on  the  original  price. Can  Jayant  recover the  extra  money  that  he  paid  ?  What  other  options  are  available  to  him  against  book-seller ?                                                                                                                              

Ans: Mr.  Jayant   is  a  cautious  consumer.  He  had  taken  the  cash  memo  for  the  book  he  purchased.  Therefore,  he  can  recover  the  extra  money  Rs.50.  Besides,  as  per  the  Consumer  Protection  Act, 1986,  following  option  are  also  available  to  him  against  the  book-seller-  (i)  He  can  return  the  book  and  ask  for  the  repayment  of  Rs.300  which  he  paid  for  buying  the  book. (ii) He  can  sue  the  book-seller  for  using  unfair  trade  practices.

 

LONG  ANSWER  TYPE  QUESTIONS(05 OR 06 MARKS EACH)

 

Ques 1: Kavita  purchased  one  litre  of  Pure  Desi  Ghee  from  a  shopkeeper.  After  using  it  she  had  a  doubt  that  it  is  adultered.  She  sent  it  for  a  laboratory  test  which  confirmed  that  the  Ghee  is  adulterated.  State  any  six  reliefs  available  to  Kabita, if  she  complains  and  the  consumer  court  is  satisfied  about  the  genuiness  of  the  complaint.

Ans: Reliefs  available  to  a  consumer  under  the  provisions  of  Consumer  Protection  Act,  1986(i) To  remove  the  defect  in  goods  or  the  deficiency  in  service. (ii) To  replace  the  defective  product  with  a  new  one,  free  from  any  defect.  (iii)  To  refund  the  price  paid  for  the  product.  (iv)  To  pay  adequate  costs  to  Kabita.(v) Not  to  offer  adulterated  ghee.  (vi) To  withdraw  adulterated  ghee  from  sale.(vii) To  pay  punitive  damages  in  appropriate   circumstances.

 

Ques 2: Explain  the  role  or  functions  of  consumer  organization  and  NGOS   for  the  protection  and  promotion  of  interest  of  consumers.

Ans: Several  Functions  are  as  follows:                                                                                                     

(i) Educating  the  general  public  about  consumer  rights  by  organizing  training  programmes, seminars  and  workshops.(ii) Publishing  periodicals  and  other  publications  to  impart  knowledge  about  consumer  problems.(iii)Carrying  out  comparative  testing  of  consumer  products  in  accredited  laboratories. (iv)Encouraging  consumers  to  strongly  protest  and  take  action  against  unfair  trade  practices.(v) Providing  legal  assistance  to  consumers.  (vi)   Filing  complaints  in  appropriate  consumer  courts  on  behalf  of  the  consumers.(vii)Taking  an  initiative  in  filing  cases  in  the  interest  of  general  public.

 

Ques 3: What  is  meant  by  ‘Consumer  Protection’ ? Also  state  how  consumer  protection  is  important  from  the  point  of  view  of  consumers.

Ans: Consumer Protection: It refers to the act of  providing  adequate  protection  to  consumers  against  the  unscrupulous, exploitative  and  unfair trade  practices  of  producers  and  traders .

Importance.

Importance  of  consumer  protection  from  consumers’  point  of  view :    

 (a) Consumers’ Ignorance- In  the  light  of  widespread  ignorance  of  consumers  about  their  rights  and  reliefs  available  to  them ,  it  becomes  necessary  to  educate  them  about  the  same  so  as  to  achieve  consumer  awareness.                                                                                    

(b) Unorganised  Consumers- In  India,  Consumers  are  not  organized.  So  consumer  organization  is  required  along  with  power  and  rights  as  per  Consumers,  protection  Act  which  protect  and  promote  the  interests  of  consumers.                                                             

 (c) Widespread  Exploitation  of  Consumers:- Unware,  ignorant  consumers  might  be  exploited  by  exploitative  and  unfair  trade  practices  like  defective  goods,  adulteration,  false  and  misleading  advertising etc.  Consumer  protection  provides  safeguard  to  consumers  from  such  exploitations.

 

Ques 4: As  a  well-informed  customer,  what  kind  of  quality  certification  marks  you  will  look  for  before  buying  products ? Specify   any  six.

Ans: (i) FPO-  It  contains  specification  and  quality  control  requirements  regarding  the  production  and  marketing  of  processed  fruits  and  vegetables,sweetend  aerated  water  and  synthetic  syrups.                                                                                                                                          

 (ii)   ISI- On  consumer  durable  products.                                                                                                     

(iii)  Hallmark -  BIS  certification  scheme  gold  jewellery  items.                                                      

(iv)  Earthern  pitcher  -  For  labelling  environment  friendly  products.                                                

(v)   AGMARK – It  is  ‘A’  grade  standard  for  agricultural  commodities  and  livestock  products.
